By accessing or using EstateShield's estate planning document generation service (the "Service") at estateshield.polsia.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

EstateShield provides an AI-powered tool that generates estate planning document templates, including Last Will & Testament, Durable Power of Attorney, and Advance Healthcare Directive documents. The Service generates documents based on information you provide and general state-specific legal requirements.

3. Important Legal Disclaimer

EstateShield is NOT a law firm and does NOT provide legal advice, legal representation, or attorney-client relationships.

The documents generated by the Service are templates for informational purposes only. They are not a substitute for professional legal advice from a licensed attorney in your state. We strongly recommend that you:

• Have all generated documents reviewed by a licensed attorney in your state before signing
• Consult with an attorney about your specific estate planning needs
• Verify that documents meet all of your state's legal requirements for execution (signing, witnessing, notarization)

EstateShield makes no guarantee that any generated document is legally valid, enforceable, or suitable for your specific circumstances. Laws vary by state and change over time. An improperly executed estate plan can have serious consequences.

4. User Responsibilities

By using the Service, you represent and agree that:

• You are at least 18 years of age
• All information you provide is accurate and complete
• You understand that generated documents are templates requiring professional review
• You are responsible for properly executing (signing, witnessing, notarizing) any documents per your state's requirements
• You will not use the Service for any unlawful purpose
• You will not attempt to access other users' data or interfere with the Service

5. Payment and Pricing

The Service costs a one-time fee of $47.00 USD for a complete document package (Last Will & Testament, Power of Attorney, and Healthcare Directive). Payment is processed securely through Stripe.

• Payment is required before you can access your generated documents
• Prices are subject to change with notice posted on the website
• All payments are in US dollars

6. Refund Policy

We offer a 100% satisfaction guarantee. If you are not satisfied with your documents for any reason, contact us within 30 days of purchase for a full refund. Refunds are processed to the original payment method within 5-10 business days.

7. Intellectual Property

Upon purchase, you receive a personal, non-transferable license to use the generated documents for your own estate planning purposes. You may not:

• Resell, distribute, or commercially exploit the generated documents
• Use the Service to generate documents for others as a business
• Copy, modify, or reverse-engineer the Service's software or algorithms

8. Limitation of Liability

To the maximum extent permitted by law, EstateShield and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Legal disputes arising from the use of generated documents
• Documents that fail to meet specific state legal requirements
• Errors or omissions in generated document content
• Loss of data or interruption of service

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service ($47.00).

9. Indemnification

You agree to indemnify and hold harmless EstateShield, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

10. Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or reasons beyond our control. We are not liable for any loss resulting from service interruptions.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Delaware.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
